An 11-year marriage between Moyosore and Olukayode has been dissolved by a Grade A Customary Court sitting in Mapo, Ibadan, Oyo State, following allegations of drug addiction, deceit, domestic violence and neglect.
The woman had approached the court seeking an end to the union, alleging that her husband deceived her about his educational background before their marriage.
Moyosore told the court that Olukayode initially claimed to have obtained a National Diploma but later admitted, shortly before their wedding, that he had been expelled from school over alleged involvement in cult activities.
She said she subsequently discovered, about a month after their marriage, that her husband was addicted to drugs and frequently used substances at home, which she said affected his behaviour.
According to her, Olukayode later resigned from his job without consulting her and became financially dependent on her, worsening the couple’s difficulties.
She further alleged that her husband eventually moved out of their home and only occasionally returned to see their children.
Moyosore also accused him of assaulting her during a disagreement, alleging that he beat her severely on one occasion until she lost consciousness.
She said the incident was reported to the police, resulting in his arrest and detention for two days.
The petitioner further alleged that her husband had threatened her on several occasions and damaged some of her personal belongings, including their wedding photographs and video recording.
Moyosore told the court that she no longer felt safe around him and had been living separately from him since 2023.
She consequently sought custody of their children, maintenance for their feeding, education and healthcare, as well as an order preventing her husband from threatening, harassing or interfering with her private life.
Olukayode was absent from the proceedings despite being served with the court summons and was therefore unable to challenge the allegations.
In her judgment, the Court President, Mrs O.E. Owoseni, said the parties had entered into a valid customary marriage but noted that the woman’s evidence remained unchallenged.
Owoseni held that the allegations of deceit, irresponsibility and drug addiction, which were not controverted by the defendant, were sufficient grounds for ending the marriage.
The court consequently dissolved the union, awarded custody of the children to Moyosore and ordered Olukayode to take responsibility for their upkeep.
The judge also issued an order restraining the defendant from threatening the woman or interfering with her private life.
