A Grade A Customary Court sitting in Mapo, Ibadan, Oyo State, has dissolved the five-year marriage between Kayode and his wife, Michelle, following allegations of excessive drinking, frequent clubbing and irresponsibility.
Kayode told the court that his wife’s alleged misconduct became worse after she failed to conceive despite several attempts by the couple to have a child.
According to him, rather than remaining concerned about their inability to have children, Michelle allegedly took to visiting nightclubs regularly, where she drank excessively.
The petitioner said the couple got married in April 2020 after he paid N25,000 as bride price, but claimed that his wife had displayed what he described as irresponsible behaviour from the beginning of their union.
He said efforts to address the situation yielded no positive result, alleging that Michelle became increasingly involved in drinking and clubbing despite his repeated complaints.
Kayode told the court that the couple had also explored both medical and spiritual options in their attempt to have a child, but none produced the desired result.
He said he could no longer endure what he considered embarrassing conduct from his wife and consequently asked the court to end the marriage.
Michelle, however, was absent from the proceedings despite being served with court summonses and did not appear to challenge the allegations.
Ruling on the matter, the court president, Mrs S.M. Akintayo, held that the payment of the bride price established the existence of a valid customary marriage.
She said Kayode’s evidence remained unchallenged and showed that the relationship had broken down irretrievably. Akintayo subsequently dissolved the marriage, declaring that both parties were no longer husband and wife.
