The Court of Appeal in Abuja has upheld the recognition of Barrister AbdulGhani Rotimi Arobo as the All Progressives Congress candidate for the Owo/Ose Federal Constituency seat in Ondo State.
The appellate court reached the decision after dismissing challenges to an earlier Federal High Court judgment that recognised Arobo as the party’s legitimate candidate for the House of Representatives constituency.
The appeals were filed by Hon. Oluwatimehin Emmanuel Adelegbe, Engr. Kayode Ijalana, Dr Abiola Oshodi and the APC, who sought to overturn the lower court’s ruling.
The court considered five appeals arising from the dispute over the party’s candidate for the federal constituency.
However, the appellate court unanimously resolved the issues raised in the appeals in Arobo’s favour, leaving the Federal High Court’s decision intact.
The ruling reinforces Arobo’s position as the recognised APC candidate in the contest for the Owo/Ose seat.
The dispute centred on who was entitled to represent the APC in the election to the House of Representatives.
With the Court of Appeal affirming the lower court’s judgment, the legal challenge to Arobo’s candidacy has suffered a major setback.
